Service Terms & Media License
Simple terms designed to protect both our clients and the creative work we produce. By booking, paying for, or using services provided by Magic Lens Photo Media LLC, you agree to the terms below.

You hire us to create the media. You receive the right to use it. Magic Lens retains the copyright.
The package you book defines the scope of the job. Once paid, the delivered media may be used to market the property or project for which it was created. Ordinary MLS, brokerage, rental-platform and social-media distribution is allowed. Independent commercial use by unrelated third parties requires separate permission.
01 Services & Booking
Magic Lens Photo Media LLC (“Magic Lens”) provides photography, video, drone, real estate media, vacation-rental media, floor plans, 3D tours, virtual staging, editing and related visual-media services.
The package, add-ons, property size, proposal or invoice selected by the client defines the scope and price of the project.
A booking becomes binding when Magic Lens accepts the order. Online checkout, electronic acceptance, scheduling or payment may constitute acceptance of these Terms.
02 Property Size, Access & Readiness
The client is responsible for selecting the correct property-size category and providing accurate property and access information. If the property falls into a higher pricing tier, Magic Lens may adjust the order before delivery.
The property must be accessible and reasonably ready at the scheduled time. Unless specifically purchased, our services do not include cleaning, staging, furniture moving, landscaping or property preparation.
If the property cannot reasonably be photographed because of access problems, unsafe conditions, occupants, or substantial lack of preparation, a rescheduling or return-visit fee may apply.
03 Cancellation & Rescheduling
Appointments reserve production time that may no longer be available to other clients.
- More than 24 hours before the appointment: rescheduling is generally permitted without a rescheduling fee, subject to availability.
- Less than 24 hours before the appointment: Magic Lens may charge up to 100% of the scheduled service fee.
- If Magic Lens arrives and the property is inaccessible, substantially unprepared or otherwise unavailable, the visit may be treated as a same-day cancellation.
Any booking fee or deposit specifically identified as non-refundable remains subject to the terms presented when booked.
04 Weather & Drone Operations
Drone services are subject to weather, airspace, safety, regulatory and operational conditions.
The pilot has final authority to determine whether a flight can be performed safely and legally.
If aerial services cannot be completed, Magic Lens may reschedule the aerial portion, provide an appropriate substitute, issue a credit, or refund the affected drone service as reasonably appropriate.
Magic Lens is not responsible for delays caused by circumstances reasonably outside its control.
05 Payment
The client agrees to pay the amount shown at checkout, in the accepted proposal, or on the applicable invoice.
Magic Lens may withhold downloadable files, final media or usage rights until amounts due for the project have been paid.
Work requested outside the original scope may be billed separately. Applicable taxes and legally permitted collection charges may also apply.
06 Delivery, Editing & Revisions
Turnaround times are those stated in the package, order or proposal. “Next-Day Delivery” applies only to services specifically advertised with that turnaround.
Video, advanced retouching, virtual staging, extensive object removal, large-volume projects and revisions may require additional time.
By hiring Magic Lens, the client accepts the general creative style shown in our portfolio.
We will correct reasonable technical errors caused by our capture or editing process. New creative preferences, property changes, additional requested angles, areas that were not ready, or changes made after the original session may require an additional fee or reshoot.
07 Copyright & Ownership
Unless a separate signed written agreement expressly provides otherwise, Magic Lens and/or the applicable creator retains the copyright in photographs, videos and other copyrightable media created for the project.
Payment purchases a license to use the delivered media, not ownership of the copyright.
The work is not considered work made for hire unless specifically agreed in a separate signed written agreement.
08 Your Media License
After full payment, the client receives a non-exclusive license to use the delivered media to market and promote the property, listing, vacation rental, business or project for which the media was commissioned.
Permitted use includes, as applicable:
- MLS and listing syndication
- Brokerage and property websites
- Airbnb, Vrbo and direct-booking websites
- Social media
- Digital advertising
- Email marketing
- Print marketing and brochures
- Client presentations
Builder, developer, architectural, commercial and recurring assignments may have broader or project-specific licensing terms stated in their proposal.
09 Third-Party Use
Ordinary MLS syndication, brokerage display and distribution associated with marketing the commissioned property are permitted.
However, the client may not independently sell, sublicense or transfer the media to an unrelated third party for that party's separate commercial use.
Builders, architects, designers, stagers, vendors, publications, other agents or other businesses seeking independent commercial use should contact Magic Lens for licensing permission.
10 Virtual Staging & Digital Alterations
Virtual staging, Virtual Twilight, object removal, sky replacement, digital décor, AI-assisted editing and similar services may alter the visible appearance of a property.
These images are marketing representations and are not documentary proof of the property's physical condition.
The client is responsible for complying with applicable MLS, brokerage, advertising-platform and disclosure requirements when using digitally altered media.
11 Floor Plans, 3D Tours & Measurements
Floor plans, measurements, square-footage estimates, 3D tours and similar products are provided for marketing and visualization purposes only.
They are not surveys, architectural plans, engineering documents, construction drawings, appraisals or guarantees of legal square footage.
Material dimensions and property information should be independently verified before being relied upon for legal, construction, valuation or transactional purposes.
12 Portfolio Use & Confidentiality
Unless confidentiality is requested in writing before the session, Magic Lens may display selected work for its own portfolio, website, social media, advertising, educational presentations and other self-promotional purposes.
Magic Lens will not intentionally publish access codes, security information, private documents or sensitive personal information.
Confidential commercial projects, unreleased properties and embargoed assignments may be covered by separate written confidentiality terms.
13 Files, Storage & Third-Party Platforms
Clients are responsible for downloading and securely backing up delivered media.
Magic Lens does not guarantee permanent storage of delivered or source files.
RAW photographs, unedited video, editing timelines, layered files and other production source files are not included unless specifically agreed in writing.
Certain services rely on third-party platforms such as Zillow, MLS systems, galleries, hosting providers, booking systems or file delivery services. Magic Lens is not responsible for outages, policy changes or functionality controlled by those third parties.
14 Client Responsibility
The client represents that they have authority to grant access to the property and to provide any logos, photographs, graphics, instructions or other materials submitted to Magic Lens.
The client is responsible for the lawful use of delivered media and for compliance with applicable MLS, brokerage, platform and disclosure rules.
To the extent permitted by law, the client is responsible for third-party claims arising from unauthorized materials supplied by the client, unauthorized use of the delivered media, or the client's failure to make disclosures required for digitally altered media.
15 Limitation of Liability
To the fullest extent permitted by law, Magic Lens will not be liable for indirect, incidental, special or consequential damages, including lost profits, lost listings, lost bookings or lost business opportunities.
Magic Lens's aggregate liability arising from a specific project will not exceed the amount actually paid to Magic Lens for the services giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited.
16 Electronic Transactions, Florida Law & General Terms
The client agrees that orders, proposals, invoices, confirmations and acceptance of these Terms may be handled electronically.
These Terms and the applicable booking, invoice or proposal form the agreement governing the project.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes will be brought in a court of competent jurisdiction in the Florida county where Magic Lens maintains its principal place of business.
If any provision is found unenforceable, the remaining provisions remain in effect.
Magic Lens may update these Terms for future bookings. The version applicable to a project is the version in effect when that project is booked, unless the parties later agree otherwise.
Project-Specific Agreements
A written proposal, commercial agreement or project-specific license may modify these Terms for builders, developers, architectural firms, commercial clients, recurring production or other custom assignments. If there is a direct conflict, the specific written agreement controls for that project.
